WPCellar respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA), we will respond promptly to notices of alleged copyright infringement that comply with applicable law.
Filing a DMCA Takedown Notice
If you believe that content available on WPCellar infringes your copyright, you may submit a DMCA takedown notice. Your notice must include the following information:
- Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, including the URL where the original work can be found.
- Identification of the infringing material: The specific URL(s) on WPCellar where the allegedly infringing content is located. Please be as specific as possible.
- Your contact information: Your full legal name, mailing address, telephone number, and email address.
- Statement of good faith: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Statement of accuracy: A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or authorized to act on behalf of the owner.
- Signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
How to Submit a DMCA Notice
You can submit your DMCA takedown notice through the following methods:
- Email: Send your complete notice to [email protected]
- Report Button: Use the “Report” button available on every page of our website to flag specific content for review.
- Contact Form: Submit a detailed report through our Contact Page.
Please include “DMCA Takedown Notice” in the subject line of your email for faster processing.
Response Timeline
Upon receiving a valid DMCA takedown notice, we will:
- Acknowledge receipt within 24 hours of receiving your notice
- Review the claim and take appropriate action within 24-48 hours
- Remove or disable access to the allegedly infringing content if the notice is valid
- Notify the uploader of the content about the takedown and their right to file a counter-notification
Counter-Notification Process
If you believe that content was removed in error or that you have authorization to use the content, you may file a counter-notification. Your counter-notification must include:
- Identification of the removed material: A description of the material that was removed and the URL where it previously appeared.
- Your contact information: Your full legal name, mailing address, telephone number, and email address.
- Consent to jurisdiction: A statement that you consent to the jurisdiction of the federal court in your district (or any judicial district if you are outside the United States).
- Statement of good faith: A statement, made under penalty of perjury, that you have a good faith belief that the material was removed as a result of mistake or misidentification.
- Signature: A physical or electronic signature.
Send counter-notifications to [email protected] with the subject line “DMCA Counter-Notification.”
Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed content.
Repeat Infringers Policy
WPCellar maintains a strict policy regarding repeat infringers:
- Users who repeatedly upload infringing content will have their accounts terminated
- We track DMCA complaints associated with user accounts
- A user who receives three valid DMCA takedown notices will be permanently banned from the platform
- Terminated accounts will have all associated content removed
- We reserve the right to terminate accounts after a single infringement in egregious cases
Report via Site Report Button
For your convenience, every page on WPCellar includes a “Report” button that allows you to quickly flag content for copyright review. This is the fastest way to bring potentially infringing content to our attention. When using the Report button:
- Select “Copyright / DMCA” as the reason for your report
- Provide as much detail as possible about your copyright claim
- Include a link to the original copyrighted work if available
- Our team will review the report and follow up via email
Limitations
Please note that many WordPress themes and plugins are distributed under the GNU General Public License (GPL), which grants users broad rights to use, modify, and redistribute the software. DMCA takedown notices for GPL-licensed code may not be applicable. However, non-code assets such as images, CSS styles, and documentation may be subject to separate copyright protections.
